Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your use of the FunnelGap platform operated by Rejne Rittel UG (haftungsbeschränkt) ("we", "us"). By using FunnelGap, you agree to these Terms. If you do not agree, do not use the service.

2. Service Description

FunnelGap provides:

  • Page Audit: Automated analysis of websites and landing pages for speed, structure, mobile readiness, conversion tracking, and trust signals.
  • Ad Audit: Cross-analysis of Google Ads and Meta Ads campaign data against landing pages, including ad headline alignment, conversion tracking audit, and waste estimation.
  • Funnel Audit: Multi-step funnel analysis for quiz and form builders (Heyflow, Typeform, etc.).
  • CRM Pipeline Intelligence: Analysis of HubSpot/Salesforce pipeline data to calculate actual conversion values.

3. Accounts

3.1 Registration

You may use certain features (Page Audit) without an account. Creating an account unlocks saving reports, Ad Audit, and paid features. You must provide accurate information and keep your credentials secure.

3.2 Account Responsibility

You are responsible for all activity under your account. Notify us immediately at info@funnelgap.com if you suspect unauthorized access.

4. Plans and Billing

4.1 Free Plan

The Free plan includes limited monthly audits and bootcamp analyses as specified on our pricing page. Free plan limits may change with 30 days notice.

4.2 Paid Plans

Paid plans (Pro, Team, Agency, Enterprise) are billed monthly via Stripe. Prices are listed on our pricing page in EUR. All prices are net (exclusive of VAT where applicable).

4.3 Cancellation

You may cancel your subscription at any time from your account settings or Stripe billing portal. Cancellation takes effect at the end of the current billing period. No refunds for partial months.

4.4 Usage Limits

Each plan includes monthly usage limits (audits, bootcamp analyses, saved projects). If you exceed your limit, additional requests will be blocked until the next billing cycle. We will not charge overage fees without your explicit consent.

5. Google Ads Integration

5.1 Authorization

When you connect your Google Ads account, you authorize FunnelGap to access your campaign data in read-only mode. We use the Google Ads API with the adwords OAuth scope. We request only the permissions necessary to provide our service.

5.2 Data Handling

FunnelGap's use of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements. We do not sell, share, or use your Google Ads data for any purpose other than providing FunnelGap's analysis features.

5.3 Disconnection

You may disconnect your Google Ads account at any time. Upon disconnection, we delete your OAuth tokens and cached campaign data within 24 hours.

6. Data You Upload

6.1 Ownership

You retain full ownership of all data you upload to FunnelGap (CSV reports, CRM exports). We do not claim any intellectual property rights over your data.

6.2 License

By uploading data, you grant us a limited, non-exclusive license to process that data solely for the purpose of providing our analysis service to you. This license terminates when you delete your data or account.

6.3 Responsibility

You are responsible for ensuring you have the right to upload and process the data you provide. Do not upload data that contains information you are not authorized to share.

7. Landing Page Scanning

When you submit a URL for audit, our bot (FunnelGapBot/1.0) fetches the publicly accessible HTML of that page. We respect robots.txt directives. We do not:

  • Access authenticated or password-protected pages
  • Bypass CAPTCHAs or access controls
  • Perform load testing or denial-of-service
  • Store the full HTML beyond the analysis session

8. Estimates and Recommendations

FunnelGap provides estimates and recommendations, not guarantees. Waste estimates, alignment scores, and conversion value calculations are approximations based on available data and industry research. They should inform your decisions, not replace professional judgement.

We do not guarantee that following our recommendations will improve your Quality Score, lower your CPC, or increase conversions. Results depend on many factors outside our control.

9. Intellectual Property

FunnelGap, including its analysis engine, scoring algorithms, alignment scorer, brain rules, and user interface, is our intellectual property. You may not reverse-engineer, copy, or redistribute our technology.

Reports generated by FunnelGap may be shared with your team and clients (including white-label exports on Agency plan). You may not resell FunnelGap reports as a standalone product.

10. White-Label (Agency Plan)

Agency plan users may customise reports with their own branding (logo, colours, company name) and remove the FunnelGap watermark. White-label reports may be shared with clients under your own brand. You are responsible for any claims your clients make based on FunnelGap's analysis.

11. Acceptable Use

You agree not to:

  • Use FunnelGap to scan websites you do not own or have permission to audit
  • Attempt to circumvent usage limits or access controls
  • Use automated scripts to access FunnelGap (use our API instead)
  • Upload malicious files or attempt to compromise our systems
  • Resell access to FunnelGap without an Agency or Enterprise plan

12. Availability and Support

We aim for 99.9% uptime but do not guarantee uninterrupted service. We may perform maintenance with reasonable notice. Support is available via email (info@funnelgap.com). Priority support is included with Team, Agency, and Enterprise plans.

13. Limitation of Liability

To the maximum extent permitted by law, FunnelGap's total liability is limited to the amount you paid for the service in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits or data.

14. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany. The courts of Berlin, Germany have exclusive jurisdiction for disputes arising from these Terms.

15. Changes

We may update these Terms with 30 days notice via email. Continued use after the notice period constitutes acceptance of the updated Terms.
